eBay claims another victory in counterfeit claim

Online auctioneer eBay claims to have won a Belgian court case against L'Oreal, after it was sued over the sale of counterfeit goods.
The Belgian commercial has ruled in favour of eBay by saying the world's largest online auctioneer did not have a general monitoring obligation of what was on offer on its site.
L'Oreal brought cases against eBay in five European nations, including Belgium.
Cases have still no been heard in the other nations.
The Belgian court ruling contrasts with a decision by the Paris commercial court in June when eBay was ordered to pay damages to Louis Vuitton for allowing fake luxury goods to be sold on its site.
A month later in New York a US district judge ruled that eBay could not be held liable for trademark infringement for counterfeit items sold through its website, rejecting a case brought by luxury retailer Tiffany.  Email this story to a friend
